This Acceptable Use Policy (“Policy”) is part of our Terms and Conditions (“Legal Terms”). If you do not agree to these Legal Terms, please do not use our Services. Your continued use of our Services constitutes acceptance of the Legal Terms.

This Policy applies to any and all:

uses of our Services (as defined in the Legal Terms),
forms, materials, consent tools, comments, posts, and all other Content available on the Services, and
material you contribute to the Services in any forum, chatroom, reviews section, or other interactive area (“Contributions”).

Use of the Services

When you use the Services you warrant that you will comply with this Policy and all applicable laws.

You must not:

Systematically retrieve data or other content from the Services to create or compile a collection, compilation, database, or directory without our written permission.
Make any unauthorised use of the Services, including collecting usernames and/or email addresses for sending unsolicited email, or creating user accounts by automated means or under false pretences.
Circumvent, disable, or otherwise interfere with security-related features (including features that prevent or restrict the use or copying of any Content or enforce limitations on use).
Engage in unauthorised framing of or linking to the Services.
Trick, defraud, or mislead us or other users (including attempts to learn sensitive account information such as passwords).
Make improper use of our support services or submit false reports of abuse or misconduct.
Engage in any automated use (e.g., bots, spiders, scripts, data mining, scraping, offline readers).
Interfere with, disrupt, or create an undue burden on the Services or the networks connected to the Services.
Impersonate another person or use another user’s username.
Use information obtained from the Services to harass, abuse, or harm another person.
Use the Services to compete with us or otherwise use the Services/Content for any revenue-generating endeavour or commercial enterprise.
Decipher, decompile, disassemble, or reverse engineer any software comprising or making up a part of the Services (except as expressly permitted by applicable law).
Attempt to bypass measures designed to prevent or restrict access to the Services.
Harass, annoy, intimidate, or threaten our staff or agents providing any part of the Services.
Remove copyright or other proprietary notices from any Content.
Copy or adapt the Services’ software (including but not limited to Flash, PHP, HTML, JavaScript, or other code).
Upload or transmit viruses, Trojan horses, or other material (including excessive capital letters and spamming) that interferes with any party’s use of the Services or modifies/impairs the operation of the Services.
Upload or transmit any material that acts as a passive or active information collection or transmission mechanism (including GIFs, 1×1 pixels, web bugs, cookies, or similar “spyware”/passive collection mechanisms/“pcms”).
Except for standard search engine or browser usage, use/launch/develop/distribute any automated system (spider, robot, cheat utility, scraper, offline reader) or any unauthorised script or software.
Disparage, tarnish, or otherwise harm (in our reasonable opinion) us and/or the Services.
Use the Services in a manner inconsistent with any applicable laws or regulations.
Use a buying or purchasing agent to make purchases on the Services.
Sell or otherwise transfer your profile.

Contributions

“Contributions” include:

any data, information, software, text, code, music, scripts, sound, graphics, photos, videos, tags, messages, interactive features, or other materials that you post, share, upload, submit, or otherwise provide on/through the Services; and
any other content, materials, or data you provide to Black Bubble Solutions Ltd or use with the Services.

We may (but are not obliged to) review or moderate Contributions. We expressly exclude liability for loss or damage resulting from users’ breaches of this Policy. You may report any Contribution you believe breaches this Policy; we will decide, in our sole discretion, whether a breach has occurred.

You warrant that:

you are the creator and owner of, or have the necessary licences, rights, consents, releases, and permissions to use and to authorise us, the Services, and other users to use your Contributions as contemplated by this Policy and the Services;
your Contributions are original and true (if they represent your opinion or facts) and comply with applicable laws;
your Contributions do not infringe the proprietary rights (including copyright, patent, trademark, trade secret, or moral rights) of any third party; and
you have verifiable consent/permission from each identifiable individual featured in your Contributions.

You must not post/transmit/upload any Contribution that:

breaches applicable law, regulation, court order, contractual obligation, this Policy, our Legal Terms, or promotes/facilitates fraud or illegal activities;
is defamatory, obscene, offensive, hateful, insulting, intimidating, bullying, abusive, or threatening to any person or group;
is false, inaccurate, or misleading;
includes child sexual abuse material or violates any law intended to protect minors;
solicits personal information from anyone under 18 or exploits people under 18 in a sexual or violent manner;
promotes violence, advocates the violent overthrow of any government, or incites/threatens physical harm;
is obscene, lewd, lascivious, filthy, violent, harassing, libellous, slanderous, contains sexually explicit material, or is otherwise objectionable (as we determine);
is discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age;
bullies, intimidates, humiliates, or insults any person;
promotes or facilitates terrorism;
infringes (or helps others infringe) third-party intellectual property, publicity, or privacy rights;
is deceitful, misrepresents your identity or affiliation, or implies the Contribution was made by someone else; or
contains unsolicited or unauthorised advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other solicitation, including any “paid-for” or compensated content (monetary or in-kind).

You must not use the Services to offer or make available any good or service involving:

items that promote, encourage, facilitate, or instruct others to engage in illegal activity;
cigarettes;
controlled substances and/or other products that present a risk to consumer safety, narcotics, steroids, or drug paraphernalia;
specific knives or other weapons regulated by law;
firearms, ammunition, or certain firearm parts or accessories;
certain sexually oriented materials or services;
items listed before the seller has control or possession of the item;
any prohibited services outlined by our payment facilitator, Ryft Pay;
any services prohibited by UK law;
stolen goods;
products or services identified by government agencies as highly likely to be fraudulent; or
any transaction/activity requiring pre-approval where such approval has not been obtained.

Reviews and ratings

If your Contribution is a review or rating, you additionally agree that:

you have firsthand experience with the services being reviewed;
your Contribution is true to your experience;
you are not affiliated with competitors when posting negative reviews (and not linked to a product/service when posting positive reviews, e.g., as owner/seller/manufacturer);
you will not draw legal conclusions about conduct;
you will not post false or misleading statements; and
you will not organise campaigns encouraging others to post reviews (positive or negative).

Reporting a breach of this Policy

We may (but are not obliged to) review or moderate Contributions and we exclude liability for actions we take in response to user breaches.

If you believe any Content or Contribution:

breaches this Policy, please call 0161 706 1952, email support@tipd.co, or use the contact details below and tell us which Content/Contribution is in breach and why; or
infringes intellectual property rights, please refer to our Legal Terms for our copyright reporting process: https://www.tipd.co/terms.

We will reasonably determine whether Content or a Contribution breaches this Policy.

Consequences of breaching this Policy

Consequences depend on severity and user history. We may, for example:

issue a warning and/or remove the infringing Contribution;
suspend or terminate your access to the Services and, if applicable, disable your account; and/or
notify law enforcement or commence legal proceedings where there is a genuine risk to an individual or a threat to public safety.

We exclude liability for actions we may take in response to breaches.

Disclaimer (monitoring & responsibility)

Black Bubble Solutions Ltd is under no obligation to monitor users’ activities and disclaims responsibility for any misuse of the Services. We have no responsibility for user-generated Content or Contributions and are not obliged to monitor or exercise editorial control. If we become aware of a breach of this Policy, we may remove the material, block your account, and report the breach to the police or a regulator. Unless otherwise stated, we owe no obligations to any person who has not entered into an agreement with us for the use of the Services.
